Directive 2003/87/EC requires that all allowances shall be held in the Union Registry. The registry system provides for the electronic recording of issuance of allowances and of all transactions involving allowances performed by account holders.
An entity with obligations under the EU ETS to report annual emissions and surrender allowances in respect of reported emissions are required to open a Holding Account with the State to which it is attributed for the purposes of EU ETS administration.
An entity, including one not having compliance obligations under the EU ETS, may open a Trading Account. This type of account cannot be used to surrender allowances to fulfil compliance obligations.
The Union Registry Regulation
The rules for the functioning of the Union Registry are set out in Commission Delegated Regulation (EU) 2019/1122 of 12 March 2019 supplementing Directive 2003/87/EC of the European Parliament and of the Council as regards the functioning of the Union Registry.
